Expert report on the encroachment of a roof over the northern boundary patio of a property with an adjacent property in Villanueva de Algaidas (Málaga)

Hello everyone. 

Today I am presenting an expert report on the encroachment of a roof over a patio by a property adjacent to the property of the following home, located in Villanueva de Algaidas (Málaga).

This project was carried out at RBM Estudio de Arquitectura by architect Raúl Benítez Molina.

The case involves a roof encroachment over a patio between two properties. The client requested the following:

- Study of the disputed area.

- Observation of the possible existence of an encroachment on their domain by the neighboring property, as well as any easements in the property titles.

- List of the actions to be carried out by the neighboring property.

After the site visit, the following was observed:

- The northern boundary of the property with the neighboring property is a straight line, without any breaks.

On the other hand, it is observed that the neighboring property encroaches on the property's land by:

- A roof overhang of approximately 25 cm and an extension of approximately 5 ml.

- A gutter with a length of approximately 5 ml.

- A sewage system using PVC pipe with a length of approximately 4.50 ml.

All of the aforementioned elements of the adjacent property encroach on the property's domain, with a width between approximately 15 cm and 30 cm, and a total length of approximately 9.50 ml.

The property titles analyzed do not show any easement that the property must bear for the benefit of the adjacent property.

In conclusion, the actions required by the owner of the adjacent property to reverse the current situation are:

- Demolition of the adjacent property elements that encroach on the property's land.

- Installation of a stormwater drainage system for the adjacent property on its own land, without any encroachment on the property's land or discharge of stormwater into the property.

The report was successfully completed and successfully reflected the client's requirements.
